1. GENERAL TERMS & CONDITIONS
i. This website is owned & operated by Antssa Pty Ltd, trading as The Perfect Package. ABN: 50122694902.
ii. By accessing, browsing or using this website, you agree to all terms, conditions & disclaimers.
iii. These terms & conditions may be amended or varied at any time by The Perfect Package. Any variation is effective immediately & by continuing to use this Website, you consent to any variation. The Perfect Package will not notify you of these variations; it is your responsibility to check these terms regularly.
iv. All products on this website are only available to be purchased by customers who can make a legally binding contract. These products are not available to anyone under the age of 18 years nor any other person legally prohibited from entering into a legally binding contract.
i. The Perfect Package gifts packages are all inclusive of delivery to any valid Australian postal address. The earliest delivery is approximately 3 business days after the order is made. We can arrange an express delivery for packages in the Melbourne metro area upon request; however, this will incur extra delivery charges.
ii. The earliest delivery time, will be 3 business days from the time & day of the order, if the order & payment is received prior to 4pm EST & the delivery location is in any capital city in Australia.
iii. Any order & payment received after 4pm EST on a business day, will be delivered within 4 business days at the earliest.
iv. The delivery date selected by the customer is the time we aim to make the delivery by at the latest, however, it can be made anytime up to or before the selected time.
Weekend & Public Holiday Deliveries
v. All gift packages are delivered between 9.00am-5.00pm, Monday – Friday, with the exception of Public Holidays. There will be no deliveries made on any Public Holiday.
vi. All orders & payments received after 4pm EST on a Friday, will be shipped out on Monday at the earliest.
vii. We are unable to deliver on Saturday & Sunday, however, there may be special circumstances where a weekend delivery has been requested in writing for large orders & quoted accordingly; this will take place only if you have been notified in writing by The Perfect Package to commit to and confirm a weekend delivery.
Deliveries in Transit
viii. The Perfect Package does not provide an estimated time of arrival once products are in transit. However, a Proof of Delivery can be made available, if requested 24 hours after the requested delivery date.
Third Party Couriers
ix. The Perfect Package gift hampers may be despatched using Australia Post or a third party courier service.
x. The Perfect package accepts no responsibility for any delay associated with Australia Post or the third party courier service.
xi. In the event that the recipient is not available to accept delivery of the gift hamper or there is no safe drop off point, Australia Post or the third party courier service will leave a card with details of where the goods can be collected from.
xii. If there is any damage to the goods or delay to the package not arriving at its destination, caused by Australia Post or the third party courier service, The Perfect Package will work with the customer to try to resolve any issues that may be caused by the transport company.
xiii. To avoid any disappointments, it is best to place all orders early to provide us the best opportunity to deliver the gift by your preferred date.
3. CUSTOMER OBLIGATIONS
i. Customers must supply The Perfect Package with a valid contact email address, phone number & phone number of the recipient. If the details supplied by the customer are invalid or not supplied, The Perfect Package accepts no liability that may arise when a customer can not be contacted.
Addresses for Delivery
ii. It is the customers’ responsibility to supply the correct delivery address of the recipient. If the delivery address is not correct & therefore the package is incorrectly delivered or not delivered, additional redelivery fees will apply.
iii. Gift hampers can only be delivered to street addresses that are clearly defined. For deliveries to schools, hospitals & businesses, deliveries will be left at the front desk or reception.
iv. If any delivery address is deemed unsafe, the gift hamper will be returned to The Perfect Package and the customer will be contacted. If the gift needs to be redelivered to an alternative address, redelivery fees will apply.
v. It is the customers’ responsibility to ensure the recipients personal details, name & address are correct. Customers should also ensure that their personalised messages are entered in the relevant area & written to their satisfaction. The Perfect Package accepts no responsibility for any incorrect spelling, grammar, phrases or format of the messages.
4. ALTERATIONS OR AMENDMENTS TO ORDERS
i. The Perfect Package can not alter or amend any order that has been paid for and has already been prepared and/or in transit.
ii. If there is a request for an amendment or alteration to an order that The Perfect Package agrees to perform, the customer may be charged additional amendment or alteration fees.
iii. For alterations or amendments to be considered, they must be requested in writing by 1.00pm EST, a minimum of 4 business days prior to the set delivery date.
iv. The Perfect Package reserves the right to not accept any alterations, amendments or cancellations to any order placed that was purchased at a special rate, purchased with a voucher, or purchase included a discount.
5. CANCELLATION OF ORDERS
i. Cancellation requests must be made in writing to The Perfect Package, email: firstname.lastname@example.org
ii. Cancellation requests must be received a minimum of 4 business days prior to the scheduled delivery day.
iii. The Perfect Package can not cancel an order that is already in transit.
iv. If the cancellation is authorised by The Perfect Package, the customer may be charged cancellation fees. The difference will be refunded to the customer within 10 working days.
v. The Perfect Package reserves the right to not accept any alterations, amendments or cancellations to any order placed that was purchased at a special rate, purchased with a voucher, or purchase included a discount.
6. COMPLAINT POLICIES
i. Any dissatisfaction with the packages or products must be communicated to The Perfect Package in writing, within 3 day of delivery. This can be sent via email to: email@example.com, or by post addressed to: The Perfect Package, PO Box 71, Kew, Vic 3101.
ii. In the event that there are damaged goods in the packages, please contact us immediately upon receipt of the damaged goods, via email: firstname.lastname@example.org.
iii. The Perfect Package reserves the right to request photos of the damaged goods and of any products that you are dissatisfied with. To assist us in resolving any complaint, we may request to collect the original products or have them returned to a reply paid address.
7. PURCHASE & SALE OF ALCOHOL
i. Under the Liquor Control Act, it is offence to supply liquor to any person under the age of 18 years. It is also an offence for a person under the age of 18 years to purchase or receive liquor from another person.
ii. For all packages that contain alcohol, there will be a box to ‘tick’ to agree that the purchaser of the package is over 18 years of age. The purchaser accepts that it is an offence to falsely represent they are of legal age to purchase alcohol and to obtain alcohol on behalf of a person who is under 18 years.
iii. The recipient of the packages containing alcohol may be asked to produce proof of age and sign for the goods.
8. PRODUCT RANGE & AVAILABILITY
i. All gift hampers are available for delivery Australia wide.
ii. The Perfect Package endeavours to fulfil orders in compliance with product descriptions.
iii. If a certain listed item is not available, The Perfect Package reserves the right to substitute the item to an item of similar quality & value, ensuring to keep the final package to the same standard of the purchase. In this instance, The Perfect Package will endeavour to notify the customer prior to delivery of the hamper
iv. For presentation purposes, the photographs showing the contents of each gift hamper may also include props and will not be included with the final product. The itemised product description will outline the contents of each final package.
9. PRICING & TRANSACTIONS
i. All prices quoted, unless otherwise stated, are inclusive of GST & are in Australian Dollars (AUD).
ii. Product prices include the first initial delivery fee. However, if for any reason the package needs to be redelivered, additional redelivery fees will apply.
iii. In the event that the customer is entitled to a refund, the refund will be made to the original credit card or paypal account.
iv. Any discount or special price will be applied to the product value only.
v. Discounts will not be applied to an order after payment has been taken. Customers entitled to a discount must enter the valid discount code prior to the order payment.
10. GIFT VOUCHERS
i. The Perfect Package will be introducing Gift vouchers soon.
11. SECURITY & PRIVACY
Collection & Use of Information
i. The Perfect Package collects personal information for the purpose of fulfilling orders for products related to this website only. There may be from time to time competitions held via this website that the personal data may also be collected for.
ii. The Perfect Package does not keep records of customer credit card details.
iii. For customer security, your IP address has been logged and will be recorded with your purchase details.
Disclosure of information
iv. The Perfect Package may only disclose personal data necessary to third party service providers for the purpose of fulfilling customer orders. The Perfect Package will not disclose personal information to third parties for marketing purposes, without prior consent.
Sender Anonymity & Disclosure
v. Customers have the right to remain anonymous except in circumstances where personal information is required to complete an electronic transaction.
vi. The Perfect Package will not disclose sender/customer information to the recipient unless agreed by the sender/customer.
i. Any party engaged in illegal activities involving the use of The Perfect Package website will be subject to civil & criminal sanctions & prosecution.
ii. It is illegal to place order under a false name, with a fraudulently obtained credit card or without the consent of the cardholder. Persons found to have placed a fraudulent order will be prosecuted.
13. GOVERNING LAW
i. The use of this website & these conditions is governed by & construed in accordance with the laws of Australia. Any legal action arising out of its use shall be brought & enforced under the applicable Australian Law.
ii. By using this website, you agree to submit to the exclusive jurisdiction of the courts of Australia.
14. TRADEMARKS, COPYRIGHTS & RESTRICTIONS
i. All material on this website is owned, operated & controlled by The Perfect Package, & is protected by copyrights, trademarks, & other intellectual property rights which are owned by Antssa Pty Ltd.
ii. All material on this website can not be copied, reproduced, modified, uploaded, posted, republished, transmitted or distributed in any way without prior written consent of The Perfect Package.
iii. Use of the materials on any other website or networked computer (for reasons other than personal use or non commercial use) is prohibited.
